General information about the company
The company Ruderschule Aegerisee GmbH (hereinafter referred to as “Ruderschule Aegerisee”) offers services in the form of rowing training. The registered seat is Silbergasse 8 in CH 6315 Oberägeri. The HR number is CHE-447.266.398. The managing directors are Holger Weissböck and Fabienne Pfister, available at mail@ruderschule-aegerisee.ch .
scope
The following conditions apply to all contracts concluded with the Aegerisee rowing school. With the conclusion of the contract, the customer confirms that they are aware of these terms and conditions and expressly agrees that these terms and conditions are part of the contract.
Change of terms and conditions
The Aegerisee rowing school reserves the right to change these terms and conditions at any time. Changes to the terms and conditions are only permitted to consumers if the change is reasonable for the consumer, especially because it is insignificant and objectively justified. The current terms and conditions are published at any time on the Aegerisee Rowing School's homepage.
Conclusion of contract
The contract for services in the form of rowing hours is concluded after the customer has registered in writing and paid (via the homepage) and written confirmation (confirmation of payment) by the rowing school.
Cancellation of the contract
A withdrawal from the contract must be declared in writing at least 24 hours before the training session. If part of the course has already been completed, there is no longer any possibility of withdrawal, except for injuries or pregnancies that make the training impossible. A written doctor's certificate is required for this.
Implementation of the training
A training unit begins at the time booked and also includes the way to and from the water as well as any video analysis and dry exercises. The rowing school has the option of relocating a trainer if the booked trainer is not available at short notice. Short-term health restrictions of the customer must be reported to the trainer before the training session begins. Permanent illnesses must be announced in writing at least 7 days before the first training session. Package or individual lessons can also be transferred to other people.

The instructions of the trainer must be followed and the material must be treated with care. Good swimming skills are a prerequisite. Since this is an outdoor water sport, only items that can tolerate moisture may be taken to the jetty and into the boat. We reserve the right to exclude group participants from the group for disciplinary reasons (e.g. endangering the other group members, repeated non-compliance with the rules of conduct and disrupting group training, etc.). In this case, there is no entitlement to reimbursement of the pro-rata training fee.
Supervision of children and minors
The duty of supervision of the rowing school is limited exclusively to the duration of the training. The guardians have to ensure that their children are brought to the rowing school on time and that they are picked up again on time. The rowing school does not assume any supervisory duties for the time before and after training.
Loss of hours
Individual lessons must be canceled by the customer 24 hours before the start of the training, otherwise the full training fee will be charged. Booked courses cannot be canceled. Exceptions can be made upon presentation of a medical certificate. Training units missed by the course participant cannot be made up for. The fee for a booked, incomplete or incomplete package cannot be reimbursed. Rowing training does not take place in adverse conditions (storms, thick fog or heavy rain). These appointments will be made up for if possible. If this is not possible for organizational reasons, the amount for the non-rowed units will be credited to the next invoice. If the training has to be interrupted due to weather conditions, the training can be continued on the rowing ergometer.
Tariff regulations, payment methods and late payment
The currently valid prices are shown on the homepage www.ruderschule-aegerisee.ch. Hours must be booked and paid for online, only then are they considered definitive.
liability
Participation in the rowing lessons is at your own risk. Parents are responsible for their children. The trainer is liable for personal injuries caused by his fault. If the contract is properly fulfilled, the trainer is not liable. The trainer's liability for property damage is limited to gross negligence. Complaints about inadequate performance of a trainer must be reported in writing within 48 hours of the relevant training session, otherwise the performance is deemed to be approved. The customer is liable for damage caused by him to the training material provided on loan by the rowing school. The rowing school is not liable for personal injury or property damage caused by a customer or the persons or animals brought by him to third parties. The rowing school assumes no liability for personal injury or damage to property that occurs as a result of unauthorized leaving the training area or caused by the child.
Liability insurance
With the conclusion of the contract, the customer confirms that he or, in the case of minors, his legal guardian, has valid liability insurance. Damage to the material caused by improper handling by the customer must be reported by the customer to the respective insurance company at the request of the rowing school.
Place of jurisdiction and applicable law
Unless otherwise stipulated by law, the place of jurisdiction for all disputes arising from this contract is Zug. Swiss law applies to all contracts concluded with the rowing school.
